中文文摘  贪污罪在国家工作人员职务犯罪中,一直占有十分重要的地位,学术界对贪污罪的研究也始终投注了极大的热情,取得了一些成果。但围绕贪污罪仍存在着一些值得进一步探讨的问题,本文即拟对这些问题作以阐述,主要包括以下四部分内容:
第一部分,介绍贪污罪的立法沿革和现行刑法对贪污罪所作的修改,经过比较分析,明确贪污行为一直是我们党和国家强烈反对的,反贪污是我们坚持的一贯方针,尤其在现阶段更应该坚持不懈地与贪污行为作斗争。
第二部分,从阐述贪污犯罪的现状出发,分析了现阶段贪污犯罪发展之快、数额之大、危害之重的经济根源、思想根源、客观条件和法制根源。
第三部分,围绕贪污罪主体展开论述。先列举比较了贪污罪主体的立法变迁,在明确其范围的基础上,概括了贪污罪主体的四个主要特征。最后,结合司法实践中某些主体能否成为贪污罪主体的问题,从五个方面进行了探析。
第四部分,主要是对贪污罪惩治的对策思考。认为既要强调运用刑罚手段,从严打击,决不手软,又要重视预防在治理贪污犯罪中的积极作用,坚持打防结合,预防为主。同时通过各项制度的完善,建立起良好的社会防控体系,以收惩治贪污犯罪的最佳效果。

英文文摘  Crime of corruption always plays a very important role in the crime by taking advantage of duty of state functionaries. Academic circles also devote extreme favor to the research of crime of corruption and make great progress, while there are some problems on crime of corruption worth of further study. In this topic, the author is going to elaborate these problems in four parts.
The first part introduces the evolution in legislation of crime of corruption and its modification current criminal law has made. The topic explicit that the practice of corruption is severely opposed by our party and country that pursue a consistent policy against it. Nowadays, we should especially fight against the practice of corruption firmly.
In the second part, on the basis of current situation of crime of corruption, the author analyses the reasons for the commitment of this crime in its fast development, large amount and serious damage in respect of economic, ideological and legal origins as well as objective conditions.
The third part is about the subject of crime of corruption. Firstly, the author enumerates and compares the legislative alteration in the subject of crime of corruption. Secondly, on the ground of the definition of its scope, the author summarizes its four main characters. Finally, in relation to the issue in judicial practice whether certain subjects may be the subjects of crime of corruption, the author demonstrates this issue in five aspects.
The last part is mainly concerning the author''s consideration on the countermeasure against crime of corruption. On the one hand, we should use criminal punishment to attack severely against it without mercy; on the other hand, we should pay attention to the active role of prevention in controlling crime of corruption and stick to putting prevention first while combining prevention and control. At the same time, via the perfection of various institutions, we can establish a better social prevention and controlling system and obtain the best effect of correcting crime of corruption.
